The broker or intermediary is a professional (or a group of professionals gathered in business or representative agencies) who does not take positions on his own but only on behalf of clients, organizing transactions between seller and buyer and obtaining a commission for the conclusion of the deal.

It means that  all the regular urban documentation is in order to be able to sell a property.

The deposit for the Italian law, is a sum of money or a quantity of other fungible things paid as a mutual and mutual guarantee against breach of contract or as consideration in the event of withdrawal from the contract. In addition it is necessary for advertising purposes, therefore it is necessary to give a copy to the real estate agency which is obliged to advertise a property by entering the data of the energy performance certificate

The buyer must afford notary fees, the tax are calculated differently if it is a primary or secondary home; the agency commission, in case you have relied on it for the purchase.

The seller must support the drafting of the integrated Technical Report; any amnesties, in case of abuses within the property;  the Energy Performance Certificate; the agency commission, in case you have relied on it for the sale.

According to art. 1754 of the Italian Civil Code, the mediator is the one who puts in relation two or more parties for the conclusion of a deal, without being linked to any of them by collaboration, dependence or representation relationships. Article 1755 indicates that the mediator is entitled to a commission from each of the parties (art.2950), if the deal is concluded as a result of his intervention. The extent of the commission and the proportion in which this must be borne by each of the parties, in the absence of an agreement, professional rates or uses, are determined by the judge according to equity.
